Rack Room Shoes Stuck With Privacy Suit Over Consumer Data

Rack Room Shoes failed to convince a district court to dismiss some claims stemming from allegations the footwear chain shares consumer data with Meta Platforms.

The plaintiffs told the US District Court for the Northern District of California that Rack Room embedded the tracking code of several third-party companies, including Meta and Attentive, into its website.

Judge Rita F. Lin declined to dismiss a federal wiretap claim against Rack Room because the plaintiffs’ allegations that it intercepted consumer data for the benefit of targeted advertising despite promising not to were sufficient to suggest that the interception was intentional.
