Consumers alleging Nestlé Waters North America Inc., now known as Blue Triton Brands Inc., deceptively advertised Poland Spring bottled water as “spring water” can advance fraud and deception claims to a jury, a federal judge ruled.
The US District Court for the District of Connecticut on Monday denied Nestle’s motion for summary judgment on the consumers’ common law fraud and unfair trade practices claims. The court granted the motion under for claims under a handful of state laws, as well as the consumers’ claims for injunctive relief.
