P.A.M. Transportation Must Face Drivers’ Hostile Workplace Suit

Two Black men alleging they were subjected to a hostile work environment at P.A.M. Transport Inc. will get a second chance to pursue their claims after a federal appeals court ruled a lower court wrongly granted the company summary judgment.

A reasonable jury could find former P.A.M. truck drivers Thomas Michael Smith and Monaleto Sneed faced severe or pervasive racial harassment during their tenures at P.A.M., Judge Jane B. Stranch said Thursday. The US Court of Appeals for the Sixth Circuit reversed the lower court’s grant of summary judgment and remanded the suit for further proceedings.
