Ohio’s top court will hear arguments Tuesday in a dispute that has united both political parties in seeking to expand their ability to file appeals.
The state Supreme Court will grapple with whether Ohio law considers a preliminary injunction blocking a state law or local ordinance a “final appealable order” that a higher court can review. That hasn’t historically been the case and has rankled Democrats and Republicans alike; those in power don’t want to wait until a case finishes at the trial level before an appeals court can step in.
