The First Circuit expressed support at oral argument for government agencies’ approval of a wind energy project off the coast of Martha’s Vineyard, suggesting they met their obligation to ensure it provides for safety and environmental protection.
“There was analysis in the record of decision of how this would affect safety, and mitigating measures were taken to include safety,” Judge Seth Aframe said in the first of two oral arguments involving the project at the US Court of Appeals for the First Circuit. “You may not agree with where they came out, but there was analysis,” Aframe said.
