New York Prevails in City Workers’ Covid Vax Religious Bias Case

Dozens of New York City government employees failed Monday to revive their religious bias lawsuit over the city’s Covid-19 vaccine requirements.

The mandates “were neutral laws of general applicability, and the City presents a rational basis for so mandating,” the US Court of Appeals for the Second Circuit said in a summary order affirming dismissal of the workers’ claims. The Second Circuit and the US Supreme Court have consistently held that the US Constitution embodies no right that would render unconstitutional vaccine mandates issued in the public interest, the court said.
