Nespresso Consumers Can’t Sue Over Warranty’s Brand Requirement

Owners of Nespresso Vertuo coffee machines lack standing to challenge warranties that the consumers say unlawfully required them to use Nespresso-brand capsules, a federal judge said in dismissing a proposed class suit.

Lead plaintiffs Abigail Shaughnessy, Aditya Pathak, and Katherine Alegre suffered no economic injury because their Nespresso Vertuo Coffee Makers didn’t malfunction during the one-year warranty period and they didn’t try to use the warranty, the court said.
