A woman alleging NBTY Inc. and Nature’s Bounty Inc. deceive consumers about hair and skin benefits of Nature’s Bounty Biotin supplements has voluntarily dropped her appeal of a class certification denial and dismissed her claims, court filings show.
The dismissal comes a month after the U.S. Court of Appeals for the Ninth Circuit said Target Corp. and two manufacturers may say a Target-branded biotin supplement “helps support healthy hair and skin.” Federal law, therefore, preempts consumer protection claims challenging the label, the court said.
