NBA Privacy Appeal Isn’t Ripe for SCOTUS Review, Consumer Says

A consumer alleging the National Basketball Association shared his video-watching history with Meta Platforms Inc. without his consent urged the US Supreme Court on Tuesday to reject the league’s appeal because of the case’s awkward procedural posture.

The NBA wants the high court to reverse a Second Circuit ruling that Michael Salazar was a “consumer” under the Video Privacy Protection Act, reviving his lawsuit and returning it to the district court.

But review of that decision by the US Court of Appeals for the Second Circuit would be made more difficult by Salazar’s simultaneous appeal of the district court’s dismissal ...
