Mondelez $8 Million False-Ad Deal Objector Drops Fee Appeal

An objector to an $8 million false-ad settlement with Mondelez International Inc. over belVita breakfast bars has voluntarily withdrawn his appeal, according to a filing in the Ninth Circuit.

Patrick McMorrow, Marco Ohlin, and Melody DiGregorio challenged statements that belVita products would provide “nutritious sustained energy” and similar phrases.

In addition to paying $8 million, Mondelez agreed to stop using the word “nutritious” and certain synonyms to describe belVita products if more than 10% of their calories come from added sugar.
