Mondelez $8 Million BelVita False-Ad Settlement Draws Appeal

An $8 million settlement resolving allegations that Mondelez International Inc. deceptively portrayed belVita breakfast bars as healthful has been appealed to the Ninth Circuit by an objector who contested the attorneys’ fees, a court filing shows.

Patrick McMorrow, Marco Ohlin, and Melody DiGregorio challenged statements that belVita products would provide “nutritious sustained energy” and similar phrases.

In addition to paying $8 million, Mondelez agreed to stop using the word “nutritious” and certain synonyms to describe belVita products if more than 10% of their calories come from added sugar.
