Mississippi Says Porn Age Gate Ruling Applies to Social Media

The US Supreme Court’s blessing of age verification rules for pornography sites means states can require social media sites to make commercially reasonable efforts to check their users’ ages, Mississippi told the high court.

The Walker Montgomery Protecting Children Online Act protects children from online harms while imposing at most a modest burden on speech, and doesn’t regulate fully protected expression, Mississippi argued in a brief Wednesday. The state said it should get the same intermediate scrutiny that Texas received in a challenge to a similar law, rather than the strict scrutiny NetChoice wants.
