Liberty U. Trans Worker Says Mid-Bias Case Ruling Not Reviewable

A transgender former Liberty University employee said the evangelical Christian school failed to raise questions in her discrimination case that the Fourth Circuit needed to immediately address.

Liberty wants to immediately appeal the denial of its motion to dismiss by the US District Court for the Western District of Virginia, saying that it’s unclear from the case law whether a religious institution is exempt from Title VII employment claims arising from its religious beliefs. It’s asking the district court to certify its Feb. 21 order for that purpose.
