LaCroix Sparkling Water Deception Suit Voluntarily Dropped

LaCroix sparking water consumers have voluntarily dismissed claims alleging National Beverage Corp. deceptively labeled the popular beverage “all natural” even though it contains synthetic flavoring ingredients, a filing in a New York federal court says.

New Yorkers Adenike Graham and Kimberly McNulty alleged LaCroix’s marketing targets health-conscious consumers looking to avoid high-sugar drinks, and said they overpaid for the sparkling water. They sought to represent a class of New York purchasers, raising claims under the state’s consumer protection law as well as breach of contract and warranty claims.
