Key Tronic Corp will have to face a negligence claim from a proposed data breach class action after a federal court said the plaintiff fixed the legal flaw that doomed the cause of action the first time around.
The plaintiff, a Key Tronic employee, previously failed to allege an injury sufficient for a negligence claim, but unauthorized credit inquiries he raised in his latest arguments meet the necessary criteria to assert the value of his data was diminished by the breach, the US District Court for the Eastern District of Washington said Thursday.
