The maker of a percussion massage gun is seeking a declaratory judgment that it’s not infringing a rival company’s patent of a similar product on Amazon.
MerchSource LLC says Hyper Ice Inc. and its subsidiary are engaging in an “objectively baseless, bad faith extra-judicial enforcement scheme” to remove MerchSource’s percussion massage guns from Amazon, according to its complaint filed in the US District Court for the Central District of California.
MerchSource’s countersuit comes in the wake of a barrage of lawsuits filed by Hyper Ice over alleged infringement of its patents related to massage devices.
