FedEx Fails to Convince Court to Revisit Worker’s Age Bias Claim

FedEx Corporate Services Inc. failed to convince a federal district court that it should take a second look at its previous decision allowing an age discrimination case against the company to proceed.

In its November 2023 ruling denying FedEx’s motion for summary judgment, Judge Michael H. Simon of the US District Court for the District of Oregon analyzed Myrna Hunter’s claim under the McDonnell-Douglas Corp. v. Green burden-shifting framework. He said that Hunter made out a prima facie case of age discrimination, which FedEx refuted with legitimate reasons for firing her.
