FedEx Worker Can Take Age Bias Claim to Trial, Gender Claim Axed

A former FedEx Corporate Services Inc. worker fired when she was 65 can take her age discrimination allegations to trial, but the company secured summary judgment on the worker’s gender bias claim.

The FedEx Corp. subsidiary argued that it terminated Myrna Sue Hunter for a legitimate reason, but the evidence for and against the age-based claim is mixed, the US District Court for the District of Oregon said. However, Hunter admitted she didn’t believe she faced discrimination because of her gender, so that portion of the suit fails, the opinion said.
