Discrimination Lawsuit Against Dish Revived For Arbitration

Dish Network LLC must arbitrate its former employee’s age and national origin discrimination lawsuit after a federal appeals court ruled Friday the suit was improperly dismissed.

The US Court of Appeals for the Fifth Circuit affirmed a district court’s grant of Dish’s motion to compel arbitration with Jesus Yanez but reversed the lower court’s decision to dismiss the suit, Judge Carolyn Dineen King said in an opinion. Yanez will have a second chance to pursue his claims against Dish and its affiliate Echosphere LLC through arbitration.
