D.C. Restaurant Group Gets Early Win Against Austin Oyster Bar

The corporate owner of Pearl Dive Oyster Palace in Washington, D.C., won a temporary restraining order and preliminary injunction in its trademark infringement suit against Pearl Dive Oyster Bar LLC in Texas.

Black’s 14th Street LLC alleges that the Austin restaurant is using its name “and iconic diver logo” in order “to trade off the resounding consumer goodwill and reputation of the Pearl Dive Oyster Palace Trademarks and Plaintiff’s Pearl Dive Oyster Palace branded restaurant and bar services,” according to the complaint filed in the US District Court for the Western District of Texas.
