Inadequate testing by a third-party laboratory led to CooperSurgical’s costly recall of its in vitro fertilization product, the medical device manufacturer claims in a lawsuit against Embryotech.
“CooperSurgical has incurred substantial direct, consequential, and reputational damage as a direct result of Embryotech’s failure to properly perform” testing that was supposed to ensure its solution was safe for embryos before it was distributed to customers, the complaint filed in Massachusetts Superior Court said. “These damages are ongoing and continuous.”
CooperSurgical has faced lawsuits in courts across the country for selling the defective solution, which individuals undergoing IVF claim destroyed their embryos. ...
