CooperSurgical Inc. was hit with two new lawsuits on Tuesday from people who hoped to have children through in vitro fertilization but whose embryos were allegedly destroyed by a defective solution the company should have recalled sooner.
The lawsuits were filed in the US District Court for the Northern District of California. The nearly identical complaints bring claims for defective design and manufacture, as well as negligence claims. They also bring claims for trespass to chattels based on framing the embryos as destroyed personal property.
