Connecticut Transgender Athlete Policy Challenge Gets Rehearing

A federal lawsuit seeking to ban transgender athletes from participating in girls’ sports in Connecticut will get a second look from the Second Circuit, which has agreed to reconsider en banc a panel’s dismissal of the claims.

A three judge panel of the US Court of Appeals for the Second Circuit affirmed dismissal of the claims by four former high school students on Dec. 16, 2022, finding they failed to establish injury, or that they’re entitled to seek monetary damages. The full court Monday agreed to rehear the case.
