Clif Bar’s Challenge to Class Status in False-Ad Suit Must Wait

Clif Bar & Co. failed to convince the Ninth Circuit to allow an immediate appeal of a district court’s decision certifying a class in a suit alleging it deceives consumers by marketing energy bars as healthful when they contain high amounts of sugar.

Ralph Milan and Elizabeth Arnold said Clif Bar’s “Nutrition for Sustained Energy” and several statements on Kid ZBars, including “Nourishing Kids in Motion,” convey a misleading health and wellness message.
