Chipotle Beats Appeal of Age Discrimination Lawsuit

Restaurant chain Chipotle was entitled to summary judgment, a federal appeals court ruled, in a lawsuit from a former employee who claimed his firing over pest and cleanliness issues at stores he managed was a cover for age discrimination.

Donald Sousa failed to provide sufficient evidence that Chipotle Services LLC’s stated reason for his dismissal was a pretext for age discrimination, Judge Carolyn B. McHugh said Monday. The US Court of Appeals for the Tenth Circuit affirmed a district court’s grant of summary judgment in favor of Chipotle.
