Capital One Settles Ex-Worker’s Overtime, Misclassification Suit

Capital One Services LLC will pay $20,000 to end a lawsuit from its former employee who claimed the company unlawfully misclassified non-managerial learning associates as exempt from overtime pay.

Judge Henry E. Hudson granted Capital One and Anne Fierbaugh’s joint motion for approval of a settlement agreement Monday, according to an order in the US District Court for the Eastern District of Virginia. Hudson dismissed Fierbaugh’s proposed class action and collective action lawsuit with prejudice and closed the case.
