Capital One Services LLC was hit with a lawsuit alleging it misclassified learning associates as exempt from overtime pay in violation of federal and state wage laws.
The lawsuit targets Capital One’s alleged policy and practice to treat non-managerial learning associates as exempt from overtime laws, even though their primary job duties were administrative and clerical in nature, not managerial or supervisory, according to the lawsuit filed in the US District Court for the Eastern District of Virginia.
