Winston & Strawn Appeals Sanctions in Apple App Store Lawsuit

Winston & Strawn will ask the Ninth Circuit to axe an order sanctioning the firm for including a “factually baseless” allegation in client Musi Inc.'s lawsuit seeking to restore the music-streaming app to Apple Inc.'s App Store following copyright infringement complaints.

The firm will challenge Judge Eumi K. Lee’s finding that its attorneys “misled the Court and wasted judicial and party resources” by alleging Apple admitted to relying on false evidence to eliminate the app, according to a notice of appeal filed Wednesday in the US District Court for the Northern District of California.
