Victoria’s Secret Wants Data-Tracking Patent Suit Thrown Out

Victoria’s Secret & Co. told a Texas federal judge that Recog IP can’t use the retailer’s store locations to establish venue for its patent infringement allegations because a subsidiary based outside of the state operates the allegedly infringing website.

Recog IP noted a Waco, Texas, retail store location for jurisdictional purposes in its September lawsuit against Victoria’s Secret, alleging the retailer’s website infringed data-tracking technology, according to Victoria’s Secret’s motion to dismiss filed Monday in the US District Court for the Western District of Texas.
