Vans Loses Bid to Sanction ‘Wavy Baby’ Artists, But Keeps Ban

MSCHF Product Studio Inc. won’t be sanctioned for failing to halt shipments of banned “Wavy Baby” shoes that Vans Inc. says infringe its look, though the ban will remain during its appeal to a New York federal appeals court.

Despite doubts that stopping the shipments was “impossible,” MSCHF’s “reasonably persistent efforts” shielded it from Vans’ bid to hold it in contempt, the U.S. District Court for the Eastern District of New York said Wednesday.
