TransUnion’s Escape of $18.3 Million Verdict Upheld on Appeal

A federal appeals court upheld a district judge’s decision to toss out a jury’s $18.3 million verdict against TransUnion LLC in a breach-of-contract case over an online marketplace’s source code.

The damages claimed by Endless River Technologies LLC were speculative and unsupported by reliable evidence, Judge Stephanie Dawkins Davis wrote for a three-judge panel in an opinion issued Wednesday in the US Court of Appeals for the Sixth Circuit. The panel affirmed the district court’s decision to vacate the award “on alternative grounds.”
