NuVasive Asks Judge to Overturn Verdict on Spinal-Screw Patents

NuVasive Inc. asked a federal judge to wipe out a jury’s finding that its screw products infringe spinal-implant patents, while the surgeon and inventor who won the verdict sought a damages trial—or a full retrial if the earlier verdict is thrown out.

The dueling post-trial motions were filed Tuesday in the US District Court for the District of Delaware. A jury in April found NuVasive infringed five of the seven spinal-screw patents Roger P. Jackson asserted and upheld their validity, while rejecting his willfulness claim and leaving the determination of damages for a separate proceeding.
