A Los Angeles manufacturer failed to show enough evidence to prove its sneakers aren’t infringing Nike Inc.'s trademarked Air Force 1’s, according to a California federal court.
La La Land Production & Design Inc. didn’t demonstrate that Nike’s trade dress for the sneakers is functional, which is required for defendants to get trademark infringement claims dismissed at this stage of litigation, according to an order from the U.S. District Court for the Central District of California.
Nike had alleged that La La Land supplied the streetwear brand Warren Lotas with fake Nike Air Force 1 sneakers.
