Netflix Can’t Pare Down Streaming Patent Infringement Suit

Netflix Inc.‘s bid to whittle down a patent infringement lawsuit fell flat, as a federal judge rejected arguments that the streaming technology it’s accused of infringing isn’t patent eligible.

VideoLabs Inc., an aggregator of video-streaming patents, sued Netflix in 2022 in the US District Court for the District of Delaware, accusing it of copying four of its patents. Netflix responded by urging the court to nix three of those patents—US Patent Nos. 7,440,559; 7,233,790, 8,605,794—and to also toss VideoLabs’ claims that Netflix willfully or indirectly infringed all four patents.
