The art collective MSCHF Product Studio Inc. said it will move to dismiss a trademark infringement lawsuit from apparel company WaveyBaby Holdings LLC over “Wavy Baby” shoes at the heart of two legal challenges.
MSCHF, the Brooklyn-based studio behind a variety of high profile art projects, said in a court document filed Sunday that the Wavy Baby shoes it released a year ago is protected by the First Amendment and the descriptive fair use defense.
