L’Oreal Wins Dismissal of One Brightex Patent on Virtual Makeup

L’Oreal USA Inc. convinced a federal judge in California to void one of two patents for skin-analysis technology its virtual makeup try-on tools are alleged to infringe.

Judge Joseph C. Spero invalidated Brightex Bio-Photonics LLC’s US Patent No. 9,842,358, finding it covers an abstract idea and lacks an inventive concept, in an opinion issued Thursday in the US District Court for the Northern District of California. He granted L’Oreal’s motion to dismiss claims related to the patent.
