Lashify Appeals Trade Commission Ending Eyelash Kit Patent Probe

The maker of popular do-it-yourself eyelash extension kits plans to challenge an International Trade Commission decision that found competing imports don’t tread on several of its patents, according to an appeal docketed at the Federal Circuit Wednesday.

Lashify Inc., which markets itself as an alternative to using mascara or salon eyelash-extension services, hit a number of retailers and manufacturers—including Walmart Inc., CVS Health Corp., and Ulta Beauty Inc.—with a September 2020 ITC complaint, alleging they infringed four of its patents by selling knockoff extension tools and systems.
