Justices Reject Cellspin Bid to Revive Fitbit Patent Lawsuit

The US Supreme Court rejected a patent owner’s petition arguing a California federal judge should have recused herself before siding with defendants including Google LLC unit Fitbit LLC in an infringement suit.

Judge Yvonne Gonzalez Rogers of the US District Court for the Northern District of California should’ve removed herself from hearing Cellspin Soft Inc.'s patent case, the company argued in a March cert petition. The patent owner pointed to work the judge’s husband did at a venture capital firm that had partnered with Google in several instances, as well as the judge’s personal stake in a hedge fund. ...
