Cellspin Asks Justices to Take Up 7-Year-Old Fitbit Patent Case

The Federal Circuit wrongly upheld a district court’s decision not to recuse herself before clearing companies including Google LLC unit Fitbit LLC in a patent-infringement suit, a petition to the US Supreme Court said.

Judge Yvonne Gonzalez Rogers of the US District Court for the Northern District of California should have removed herself from hearing Cellspin Soft Inc.'s patent suit, the company said in a cert petition made public March 4.
