Alleged sellers of knock-off Herbal Brands Inc. wellness products failed to convince the US Supreme Court to hear their argument that selling products into a district via Amazon.com can’t by itself create jurisdiction there.
Herbal Brands revived its Arizona federal trademark suit against a group of New York companies including Photoplaza Inc., Goldshop 300 Inc. and Instock Goodies Inc. before the US Court of Appeals for the Ninth Circuit last July. The appeals panel found the defendants’ Amazon sales into Arizona constituted an intentional act directing their activities to the state, having “conitnuously and deliberately exploited the forum market.”
