Herbal Brands’ Trademark Suit Against Amazon Sellers Revived (1)

An Arizona-based health and wellness product distributor will get another shot at holding alleged unauthorized sellers of its goods accountable, thanks to a decision by the US Court of Appeals for the Ninth Circuit.

The Ninth Circuit reversed the US District Court for the District of Arizona’s decision to dismiss Herbal Brands, Inc.'s trademark infringement lawsuit against New York residents selling products via Amazon storefronts such as Photoplaza Inc. and Goldshop Inc. in an opinion issued Wednesday.
