Grownsy International LLC dropped its lawsuit seeking a court ruling stating its baby hip seat carrier products don’t infringe Tushbaby Inc.'s trade dress.
The Georgia-based company filed a notice of voluntary dismissal of its suit seeking declaratory judgment on its rival’s trademark Tuesday in the US District Court for the Northern District of Illinois.
Tushbaby sent a cease-and-desist letter in August accusing Grownsy’s similar products of infringing Tushbaby’s trade dress for a carrier with a three-dimensional pocket and flap design, the Sept. 11 complaint said.
Grownsy filed suit asking the court for judgment declaring Tushbaby’s trade dress registration is invalid. ...
