Covid-Test Swab Patent Appeal Dismissed as Court Lacks Authority

The Federal Circuit declined to once again step into a patent-infringement fight over the swabs used to test for Covid and other diseases, finding the court lacks jurisdiction to hear Puritan Medical Products Co.'s appeal.

A district court’s denial of Puritan Medical’s motion to dismiss the infringement lawsuit brought by Copan Italia SpA isn’t reviewable because the ruling wasn’t a conclusive determination of an issue in the case, the US Court of Appeals for the Federal Circuit ruled Tuesday.
