Build-a-Bear’s Lawsuit Over ‘Squishmallows’ Fails in Missouri

Build-a-Bear Workshop Inc.'s trade dress lawsuit against the makers of Squishmallows plush toys was tossed out of a Missouri federal court after a judge found it doesn’t have jurisdiction over the competitor.

Build-a-Bear sued Berkshire Hathaway Inc.-owned Kelly Toys Holdings LLC and Jazwares LLC in February in the US District Court for the Eastern District of Missouri, seeking a declaratory judgment that the teddy-bear seller’s Skoosherz plushies don’t infringe their rights in the Squishmallows toys.
