Toy maker Build-A-Bear Workshop Inc. filed a declaratory judgment action seeking a ruling that its Skoosherz plushies don’t infringe the rights of Jazwares LLC in its Squishmallows plush toys, and on the same day, Jazwares filed infringement claims against Build-A-Bear in another state.
Jazwares, subsidiaries Kelly Toys Holdings LLC and Kelly Amusement Holdings LLC, and related entity Jazplus LLC filed suit in the US District Court for the Central District of California Monday, alleging trade dress infringement under the Lanham Act; common law trade dress infringement; copyright infringement under the Copyright Act; and unfair competition.
