BJ’s Wants Walmart Lawsuit on Self-Checkout App Feature Tossed

BJ’s Wholesale Club Holdings Inc. asked a federal court in Florida to toss Walmart Inc.’s patent infringement lawsuit over the Express Pay function of BJ’s mobile app, arguing that the patents shouldn’t have been issued and that the suit “fails to plead facts sufficient to support its infringement allegations.”

Walmart’s Sam’s West Inc. and Walmart Apollo LLC units, collectively called Sam’s Club here, sued BJ’s March 22 in the US District Court for the Middle District of Florida, alleging BJ’s Express Pay feature “is an apparent copy” of Sam’s Club’s “elegant” Scan & Go feature, “merely changing the in-app colors” ...
