Bayer Trademark Suits Stymie Competition, Accused Infringer Says

Bayer Healthcare LLC‘s “wave of litigation” against third-party Amazon vendors exploits its trademark rights to stifle competition for Claritin and other products, a company accused of illegally selling over 64,000 Bayer products said.

Bayer has filed five “sham” lawsuits since August 2022 to preserve its monopoly power over Claritin by eliminating third-party sellers of the allergy medicine from Amazon.com Inc.‘s platform, Sigma Deals LLC said in its answer and antitrust counterclaims filed Monday in the US District Court for the District of New Jersey.
