An Illinois wholesale bakery and its insurer settled a coverage dispute over the costs of a proposed class action alleging the bakery violated the state’s landmark Biometric Information Privacy Act.
The US District Court for the Northern District of Illinois dismissed the case Tuesday pursuant to a settlement agreement between Acuity, A Mutual Insurance Co. and Talerico Martin Corp.
- Acuity sued the bakery in June 2024, seeking a declaration that the underlying BIPA suit wasn’t covered under commercial general liability and excess policies issued to the bakery.
