A former Wyoming medical board member dropped his appeal from a federal court order denying his reinstatement to the board pending trial, after a lower court subsequently ruled against him on the merits of his First Amendment retaliation claim.
Frederick Cubin acknowledged in a May 2 motion to dismiss that the preliminary injunction appeal is now moot and agreed with Gov. Mark Gordon (R) that it should be abandoned. The US Court of Appeals for the Tenth Circuit entered a docket-only order May 2 ending the appeal.
