PhRMA Seeks Supreme Court Review on State Discount Drug Limits

A leading drugmaker industry group is asking the US Supreme Court to review its case against an Arkansas law that strips manufacturers’ ability to impose conditions on the use of contract pharmacies under a federal drug discount program.

The Pharmaceutical Research and Manufacturers of America’s petition for a writ of certiorari comes months after the US Court of Appeals for the Eighth Circuit earlier this year rejected the group’s preemption argument and denied rehearing en banc in a challenge against Arkansas’ Act 1103.
